Default Tupe

Need some advice on TUPE (Transfer of Undertakings - Protection of Employment), specifically details regarding employees who are being transfered from one company to another and their rights.
I know the basics but need to know if an employee is offered the same position in another company can he refuse the offer and still get a redundancy payout?

Yes I think he can refuse the offer if he has good reasoning such as travel or health problems but generally the offer will go through if the rate of pay is same or higher. Which works out better for the employee however I reccomend doing some further search on search engines and some very pronounced sites.

See your union or talk to your solicitor before doing anything because TUPE is quite tricky. If you don't have a solicitor or union (or can't afford one) then talk to the Citizen's Advice Bureau.
